The left ventricular assist device was originally designed to be surgically implanted as a bridge to transplantation for patients with chronic end-stage heart failure. On the basis of the REMATCH trial, the US Food and Drug Administration and the US Centers for Medicare & Medicaid Services approved permanent implantation of the left ventricular assist device as a destination therapy in Medicare beneficiaries who are not candidates for heart transplantation. The use of the left ventricular assist device as a destination therapy (...) raises certain ethical challenges. Left ventricular assist devices can prolong the survival of average recipients compared with optimal medical management of chronic end-stage heart failure. However, the overall quality of life can be adversely affected in some recipients because of serious infections, neurologic complications, and device malfunction. Left ventricular assist devices alter end-of-life trajectories. The caregivers of recipients may experience significant burden (e.g., poor physical health, depression, anxiety, and posttraumatic stress disorder) from destination therapy with left ventricular assist devices. There are also social and financial ramifications for recipients and their families. We advocate early utilization of a palliative care approach and outline prerequisite conditions so that consenting for the use of a left ventricular assist device as a destination therapy is a well informed process. These conditions include: (1) direct participation of a multidisciplinary care team, including palliative care specialists, (2) a concise plan of care for anticipated device-related complications, (3) careful surveillance and counseling for caregiver burden, (4) advance-care planning for anticipated end-of-life trajectories and timing of device deactivation, and (5) a plan to address the long-term financial burden on patients, families, and caregivers. Short-term mechanical circulatory devices (e.g. percutaneous cardiopulmonary bypass, percutaneous ventricular assist devices, etc.) can be initiated in emergency situations as a bridge to permanent implantation of ventricular assist devices in chronic end-stage heart failure. In the absence of first-person (patient) consent, presumed consent or surrogate consent should be used cautiously for the initiation of short-term mechanical circulatory devices in emergency situations as a bridge to permanent implantation of left ventricular assist devices. Future clinical studies of destination therapy with left ventricular assist devices should include measures of recipients' quality of end-of-life care and caregivers' burden. (shrink)

We identify the computational complexity of the satisfiability problem for FO 2 , the fragment of first-order logic consisting of all relational first-order sentences with at most two distinct variables. Although this fragment was shown to be decidable a long time ago, the computational complexity of its decision problem has not been pinpointed so far. In 1975 Mortimer proved that FO 2 has the finite-model property, which means that if an FO 2 -sentence is satisfiable, then it has a finite (...) model. Moreover, Mortimer showed that every satisfiable FO 2 -sentence has a model whose size is at most doubly exponential in the size of the sentence. In this paper, we improve Mortimer's bound by one exponential and show that every satisfiable FO 2 -sentence has a model whose size is at most exponential in the size of the sentence. As a consequence, we establish that the satisfiability problem for FO 2 is NEXPTIME-complete. (shrink)

In three parts, this volume in the AP-LS series explores the phenomena of captivity and risk management, guided and informed by the theory, method, and policy of psychological jurisprudence. The authors present a controversial thesis that demonstrates how the forces of captivity and risk management are sustained by several interdependent "conditions of control." These conditions impose barriers to justice and set limits on citizenship for one and all. Situated at the nexus of political/social theory, mental health law and jurisprudential ethics, (...) the book examines and critiques constructs such as offenders and victims; self and society; therapeutic and restorative; health; harm; and community. So, too, are three "total confinement" case law data sets on which this analysis is based. The aim of this paper is to clarify Spinoza’s views on some of the most fundamental issues of his metaphysics: the nature of God’s attributes, the nature of existence and eternity, and the relation between essence and existence in God. While there is an extensive literature on each of these topics, it seems that the following question was hardly raised so far: What is, for Spinoza, the relation between God’s existence and the divine attributes? Given Spinoza’s claims that there are (...) intimate connections between God’s essence and his existence – “God’s essence and his existence are one and the same”(E1p20) – and between God’s essence and the attributes – “By attribute I understand what the intellect perceives of substance, as constituting its essence” (E1d4), we would naturally expect that by transitivity, there is a significant relation between God’s existence and the attributes. Yet, as far as I know, there is little, if any, attempt in the existing literature to explicate such a relation, and it is one of my aims of this study to both raise the question and answer it. Eventually, I will argue that for Spinoza God is nothing but existence, and that the divine attributes are just fundamental kinds of existence, or, what is the same, as I will later argue, the intellect’s most fundamental and adequate conceptions of existence. In the first part of the paper I provide some background for Spinoza’s brief discussion in the TTP of God’s name and essence by studying the claims of Maimonides in the Guide of the Perplexed that God’s true essence is necessary existence, and that this essence is denoted by the ineffable Hebrew name of God, the Tetragrammaton (YHVH). In the second part of the paper I point out similar claims Spinoza presents in the TTP, and show how they respond to and echo Maimonides’ discussion in the Guide. In the third part, I examine Spinoza’s apparently conflicting claims in the Ethics about the relationship between God’s essence and existence. In some places Spinoza claims that God’s essence and existence are strictly identical (E1p10: “God’s essence his existence are one and the same”), but in other passages he makes the apparently much more modest claim that God’s essence involves existence (E1d1, E1p7d and E1p11d), which may lead one to believe that there is more to God’s essence than mere existence. I show that Spinoza’s understanding of the relation denoted by the Latin ‘involvit’ is consistent with the strict identification of essence and existence in God, and that Spinoza identifies God’s essence with self-necessitated existence, or eternity. Indeed, Spinoza’s understanding of eternity [aeternitas] as self-necessitated existence (E1d8) is one of the very few Spinozistic concepts that has no trace in Descartes. In this part I will also solve the long-standing problem of the sense in which the infinite modes can be called ‘eternal.’ In the fourth part I turn to the relation between the divine attributes and God’s existence and argue that, for Spinoza, the attributes are self-sufficient and adequate conceptions of existence. Finally, I will attempt to explain what brought Spinoza to deify existence. -/- Part I: “In that Day shall God be One, and his Name One”- Maimonides on God’s Name and Essence. -/- 1.1 Before we delve into the texts, let me suggest a few distinctions between various views on the issue of the relation between essence and existence in God. The view I suspect both Maimonides and Spinoza subscribe to can be termed the divine essence-existence Identity Thesis. -/- Identity Thesis (IT): God’s essence is existence and nothing but existence. We should distinguish the Identity Thesis from the much more common view according to which God’s essence contains existence, or (which I take to be roughly the same) that existence is one of the properties or perfections which constitute God’s essence. The latter view allows for the possibility (though it does not demand) that there is more to God’s essence than bare existence (e.g., God’s essence may include omniscience, omnipotence, etc.). The analysis of a previous paper (see Ref. 1), in which the possibility of a Finslerian generalization of the equations of motion of gravitational field sources was demonstrated, is extended by developing the Finslerian generalization of the gravitational field equations on the basis of the complete contractionK = K lj lj of the Finslerian curvature tensorK l j hk (x, y). The relevant Lagrangian is constructed by the replacement of the directional variabley i inK by a vector fieldy i (x), (...) so that the notion of osculation may be regarded as the key concept on which the approach is based. The introduction of the auxiliary vector fieldy i (x) is shown to be of physical significance, for the field equations refer not only to the proper field variables but also to a special coordinate system associated withy i (x) through the Clebsch representation of the latter. The status of the conservation laws proves to be similar to that in the theory of the Yang-Mills field. The paper advances a Humean metaethical analysis of "intrinsic value" - a notion fundamental in moral philosophy in general and particularly so in environmental ethics. The analysis reduces an object's moral properties (e.g., its value) to the empirical relations between the object's natural properties and people's psychological dispositions to respond to them. Moral properties turn out to be both objective and subjective, but in ways compatible with, and complementary to, each other. Next, the paper investigates whether the Humean analysis can (...) support non-anthropocentric environmental ethical theories, which attribute intrinsic value to nonhuman natural entities. It argues that one of the most useful resources from Hume for non-anthropocentrism is his account of justice as an artificial virtue, which is a plausible model for the internalization of various environmentally friendly conventions and the creation of environmental values. Finally, the paper concludes that any Humean account of intrinsic value is empiricist all the way down. Moral questions about what things are intrinsically valuable, and to what extent they are so, are ultimately empirical questions about complex psychological capacities and dispositions of human beings, which cannot be single-handedly answered by philosophers a priori; and that ethics is more appropriately seen as an interdisciplinary investigation, requiring collaboration among the various psychological and social sciences, human biological and neurological sciences, and history and philosophy. The current study assessed the extent to which the use of referential prosody varies with communicative demand. Speaker–listener dyads completed a referential communication task during which speakers attempted to indicate one of two color swatches (one bright, one dark) to listeners. Speakers' bright sentences were reliably higher pitched than dark sentences for ambiguous (e.g., bright red versus dark red) but not unambiguous (e.g., bright red versus dark purple) trials, suggesting that speakers produced meaningful acoustic cues to brightness when the accompanying (...) linguistic content was underspecified (e.g., “Can you get the red one?”). Listening partners reliably chose the correct corresponding swatch for ambiguous trials when lexical information was insufficient to identify the target, suggesting that listeners recruited prosody to resolve lexical ambiguity. Prosody can thus be conceptualized as a type of vocal gesture that can be recruited to resolve referential ambiguity when there is communicative demand to do so. (shrink)

A so called “weak value” of an observable in quantum mechanics (QM) may be obtained in a weak measurement + post-selection procedure on the QM system under study. Applied to number operators, it has been invoked in revisiting some QM paradoxes (e.g., the so called Three-Box Paradox and Hardy’s Paradox). This requires the weak value to be interpreted as a bona fide property of the system considered, a par with entities like operator mean values and eigenvalues. I question such an (...) interpretation; it has no support in the basic axioms of quantum mechanics and it leads to unreasonable results in concrete situations. (shrink)

Todas estas características antes mencionadas contribuyen, en el ámbito de la desterritorialización, a desalojar posturas que tienden a anquilosarse en conceptos fijos y sin movimiento, por lo que los distintos rasgos narratológicos en las novelas (...) híbridas --aquellas que están compuestas por una yuxtaposición de subgéneros-- siempre estarán emparentados con las nociones de heterogeneidad, diversidad y pluralidad, en el marco de la caída de los grandes relatos del siglo XX. This text makes a narrative study of the novel by Jorge Volpi No será la Tierra.We analyze the contradictory structure of the book, the multiple frames, the polyphonic narrator, the post-apocalyptic time, the antiutopic and disenchanted space, and the characters, co-protagonists of the twentieth century. All these features contribute, in the field of deterritorialization, to vacate positions that tend to stiffen in fixed and motionless concepts, so that different narratologic features in hybrid novels --those that consist of a juxtaposition of subgenera-- always be related to the notions of heterogeneity, diversity and plurality, as part of the fall of the great stories of the twentieth century. The relationship between the necessity to ensure that information is shared in the stages of deliberation and the overcoming of what Dryzek (2001) called constriction of deliberative economy is directly related to the proponents and opponents’ propensity to submit and add information differently, in a plural manner. This article describes the salient features of the deliberative turn in order to defend that this propensity is not individual. The evolution of the public space in science and in politics are both paradigmatic (...) examples to appreciate that individual deliberation, and even mere aggregation of opinions, are consistently interpreted only if they are part of social practices and collective institutions aimed at defending tolerance towards positions, beliefs and interpretations that are different or even confronted. This paper argues that the so called model of contestatory deliberative democracy contributes to the acquisition of knowledge precisely because it fosters a plurality of epistemic states associated with practices as consensus and dissent. The sum, difference, product and quotient of two functions with different domains are usually defined only on their common domain. This paper extends these definitions so that the sum and other operations are essentially defined anywhere that at least one of the components is defined. This idea is applied to propositions and events, expressed as indicator functions, to define conditional propositions and conditional events as three-valued indicator functions that are undefined when their condition is false. Extended operations of "and", "or", (...) "not" and "conditioning" are then defined on these conditional events with variable conditions. The probabilities of the disjunction and of the conjunction of two conditionals are expressed in terms of the conditional probabilities of the component conditionals. In a special case, these are shown to be weighted averages of the component conditional probabilities where the weights are the relative probabilities of the various conditions. Next, conditional random variables are defined to be random variables X whose domain has been restricted by a condition on a second random variable Y. The extended sum, difference, product and conditioning operations on functions are then applied to these conditional random variables. The expectation of a random variable and the conditional expectation of a conditional random variable are recounted. Theorem 1 generalizes the standard result that the conditional expectation of the sum of two conditional random variables with disjoint and exhaustive conditions is a weighted sum of the conditional expectations of the component conditional random variables. Because of the extended operations, the theorem is true for arbitrary conditions. Theorem 2 gives a formula for the expectation of the product of two conditional random variables. After the definition of independence of two random variables is extended to accommodate the extended operations, it is applied to the formula of Theorem 2 to simplify the expectation of a product of conditional random variables. Two examples end the paper. The first concerns a work force of n workers of different output levels and work shifts. The second example involves two radars with overlapping surveillance regions and different detection error rates. One radar's error rate is assumed to be sensitive to fog and the other radar's error rate is assumed to be sensitive to air traffic density. Taking into account the critical analysis of the first scientific magazines written in Spanish during the so-called “República de las letras”, the author explores the progressive constitution of the written press as an ideal public space to express Opinion and Thought. The study looks over the formation of the abovementioned public space from a point of view of its dimension and both as a cognitive and juridic agent. In this article, the contradictions, paradoxes and limitations of that double dimension are (...) explored. Purpose of the study is to find out the interdependence of the event as a factor of transformations in the established areas of human life and everyday routine as a way of existence of social being, which cover various types of human activity. Theoretical basis of the research is based on understanding of everyday routine as a form of social reality, a complex and multidimensional object that is constantly evolving, includes new forms of reality, and is influenced by various social (...) changes. The main function of everyday routine is the survival of individual and society, therefore the stable foundations of human existence play a dominant role in every life. In turn the event serves as a way of being existence, has a singular character, an individual expression, identifies elements that do not fit into the usual framework of everyday life. Originality of the obtained results lies in understanding event as the opposition of the phenomena world to the out of experience world of being, unexpected innovation that leads to the emergence of behaviours and structures that are new and unusual for everyday life. Event is not identical to empirical facticity, does not correspond to the usual understanding of phenomena and processes, and leads to a break from the everyday life, as it causes significant changes in human life on the individual and social levels. Unexpected change in everyday life caused by event is a traumatic collision with another dimension of being for an individual, as a result of it new meanings may open. Conclusions. On the background of everyday life, which is able to be in different states, function in a variety of relationships, to be manifested in numerous structures, junctions and connections, the event assumes the prospect of a new reality, contrary to previous representations. From existential point of view, event is always an interruption of everyday life, as for example, love or religious conversion. A large-scale event causes shocks that affect most or all individuals and communities that use multiple ways to react to an event – interpretation, selection, glorification, silence, valuations adjustment, phenomena, facts, celebration of holidays, rituals that are periodically repeated. Gipps IN THIS RESPONSE to Neil Pickering's paper I shall focus only on what he describes as the "strong objection" to the typical use of the likeness argument. The likeness argument, to recap, has it that we can decide whether conditions such as schizophrenia, depression, or alcoholism do or do not deserve (...) the designation of illness depending on whether they possess features which, if they occurred in physical conditions, would enable one to decide for or against the designation. To take an implausible example, if it were decided that it would be enough to describe a physical condition as an illness if it involves pain not caused through injury, then a psychological condition would be appropriately described as an illness just to the extent that it too involved such pain.In arguing against typical deployments of the likeness argument, Pickering finds that it is only on questionable initial descriptions of psychological conditions that such conditions appear to share the features that, in physical conditions, would be taken to be indicative of illness. That is to say, theorists who deploy the likeness argument to urge either the reality or unreality of mental illnesses typically presuppose what both we and they had all along hoped would be demonstrated in their argument. In terms of the above example, we might say that a certain psychological condition can count as an illness if it involves psychic pain. The concept of psychic pain is however (so the argument would have it) contestable; there exist other descriptions that make no reference to pain and in so doing fail to provide what a user of the likeness argument would need to substantiate the claim that a conception of the condition as an illness is more than a façon de parler.By way of arriving at this conclusion the following precondition for the applicability of the likeness argument (Pickering's "assumption" (2)) is insisted on: "That, with respect to the presence or absence of [those features of conditions which features decide whether or not the conditions are illnesses], a condition such as schizophrenia [must be] describable independently of the category it is assigned to." The enrichment of our notions of the views of the founders of Marxism with respect to esthetics and literary criticism has promoted the further development of the discipline of esthetics. What happens at the end of a clinical trial for an investigational neural implant? It may be surprising to learn how difficult it is to answer this question. While new trials are initiated with increasing regularity, relatively little consensus exists on how best to conduct them, and even less on how to ethically end them. The landscape of recent neural implant trials demonstrates wide variability of what happens to research participants after an neural implant trial ends. Some former research participants (...) continue to receive support for their devices (e.g., battery and component replacements, software updates, etc.). Others, when safe, have their neural implants removed through surgical explantation. Still others continue to live with a deactivated neural implant embedded in their body. In the United States, there are no uniform requirements to provide services, of any kind, after an neural implant study ends, and other nations are similarly facing this challenge. The existence of a post-trial gap in an expanding neural implant research ecosystem invites obvious questions: What is owed to neural implant research participants post-trial, and why has providing it been so difficult to accomplish in practice? To take a step forward on this difficult issue, we assembled one group of stakeholders – researchers funded for neuroethics grants by the National Institutes of Health – to explore possible starting points on one topic: ethical guidance for post-trial care of research participants in neural implant trials. Based on shared concerns discussed in the expert workshop the current paper is a call to action. It reports the key areas of convergence from the meeting and highlights important next steps towards developing much needed guidance. (shrink)

Se intenta mostrar que gran parte del debate se debe a las diferencias políticas entre los contendientes y a sus diferentes concepciones sobre la filosofía, la ciencia y la razón, pero no a la falta de intereses (...) políticos de Neurath y del Círculo de Viena. In this work we will summarize the Neurath-Horkheimer debate as an example of the recovery of the Vienna Circle's political aspects that were forgotten in the traditional view, so as to achieve a better understanding of the different positions assumed by the Circle's members. Our intention is to show that much of this debate stems from their political differences and the contenders' diverse conceptions of philosophy, science and reason, but not from the lack of political interests in Neurath and the Vienna Circle. Things get notoriously tricky when in the philosophical context the question is asked with a presumption of intelligibility despite ‘x’ being, say, an abstract noun formed from an adjective (‘consciousness’ out of ‘conscious’; ‘happiness’ out of ‘happy’; ‘madness’ out of ‘mad,’ etc.). For “what is?” questions are typically most perspicuously mooted when what’s being pursued are enquiries into (what we might call) the ‘essential nature’ of (what philosophers used to call) ‘substances’ or (of what are more ordinarily called) types of ‘thing’ or ‘entity.’ Invoke, by taking one’s lead from the fact that an ‘x’ is grammatically speaking a substantive, the specter of substance, and you can endlessly baffle yourself by now pondering the mysteries of the putative thing. (Vide discussions of “the nature of consciousness.”) Hence the boon of instead pursuing questions of an ‘opposed to what?’ sort; hence Wittgenstein considering using the Earl of Kent’s “I’ll teach you differences” (King Lear) as a motto for his Investigations. Rather more reflective wisdom regarding ‘x’ may thus be gained when we learn to contrast it with ‘y’ and ‘z’ than when peering into x’s non-existent constitution or groping for its never-instituted genus.Later, I make the case that Garson’s conception of reason itself might suffer from a form of substantialization and that, if I’m right in this, troubling implications follow for his approach to madness. But let’s begin by considering his enquiry into the relation of madness, idiocy and reason. So perhaps we’re reflecting on matters legal, and considering—since we’d hitherto been inclined to take ‘reason’ as univocal—what justifies our different treatments of the insane, the intellectually subnormal, and the normal. Or perhaps—proceeding from the same inclination—we’re puzzled by how someone may boast an exceptional IQ or demonstrate marvelous formal rationality (i.e., make deductions of a sort which would please the logician if no-one else) and yet still be quite mad. And then we realize that at which Garson’s Late Moderns seem to have been gesturing: The lack of reason qua intelligence in idiocy is a different [End Page 307] species from the lack of reason qua sanity in madness. An amethyst is lifeless in a different manner than an expired possum (it was never living, never moribund); the arational lack reason in a different sense than do the irrational (and a baobab cannot jump to conclusions.) There is, say his Late Modern theorists, something ‘perverse’ rather than simply deficient about the irrationality of madness.Now an important part of Garson’s thesis has it that “idiocy is a better candidate for the opposite of reason than madness.” One of the reasons for his making this claim is that he follows his Late Moderns in claiming that madness has reason somehow alive within it, albeit in an unconventional or surprising form. I return to his own explication of this below. Consider first, though, the different thought-referencing descriptions under which the speech acts of the thought-disordered, the speech-disordered, the delusional, and the learning disabled subject may be brought. ACCORDING TO HUME, the "religious hypothesis" is "a particular method of accounting for the visible phenomena of the universe''1 that is "mere conjecture and hypothesis," (Enquiry, 145) and "both uncertain and useless" (Enquiry, 142). But there was one version of this hypothesis that seemed to pose particular difficulties for him in making these claims convincing. This was Shaftesbury 's (...) view of the world as the object of "divine passion." Besides Shaftesbury's massive influence at the time, Hume was wrestling with the peculiar disadvantage of having agreed with him on so many points, particularly in the attempt to solve the problem of personal identity. He attempted to discredit Shaftesbury's "particular method" on several levels: viz., it cannot be rationally justified, deductively or inductively ; it is not really a belief, so afortiori it is not a natural belief; to the extent it is confused with a genuine belief, its effects are very rare and transitory unless it degenerates into superstition or enthusiasm, which are demonstrably pernicious. 2 These attacks were frequently reinforced with arguments ad hominem. Shaftesbury's theism is extremely ambiguous. In the Essay Concerning Virtue or Merit he pronounced, "to believe therefore that everything is governed, ordered, or regulated for the best, by a designing principle or mind, necessarily good or permanent, is to be a perfect theist" (CH I:240). This is merely the least common denominator of what all eighteenth-century natural theologians agreed could be inferred a posteriori from some form of design argument. When, in dealing with modern critics of Origen, he roundly castigates the scholarly ghettoism that goes on, one is in complete sympathy. Kerr for instance (...) gets scolded for not quoting De Lubac. Lutheran scholars and Catholic, Germans perhaps and French, will tend to approach Origen with preformed conclusions. They have too often written within an exceedingly limited scholarly tradition. Fair enough. People have not any excuse for ignoring one another's contributions. Evidences of this sort of thing, with conspicuous faults on both sides (Lutheran and Catholic, that is) are not far to seek, God knows. One is not so happy however when the faint suggestion is made, particularly in the appendix, that it is only to students with the proper dispositions that Origen will yield up his message. That one must believe with Origen, so to speak. It may be the enthusiasm of the moment, or the undue influence of Origen's own attitude to holy writ; but this could be a disastrous line of argument. It comes perilously near to the reasons Julian the Apostate gave for excluding Christians from the Hellenist schools. And it smacks too much of Hellenistic ideas about doctrine for the multitude and for the initiate. Minor, sometimes indirect, causes have kept the name of John Duns Scotus in the minds of many philosophers of the twentieth century. The dependence of Gerard Manly Hopkins' notion of inscape on Duns Scotus' doctrine on intuitive cognition and individuation is a case in point. Another and more direct instance is that of the concurrence of some modern theories on free will with the exposition of Scotus. Those whose interest in Duns Scotus has been piqued by some allusion invariably ask the question, where can one get something in English by the man? The answer still is, the man has had quite a few expositors but not many translators. The latest of such expositions is Duns Scotus: The Basic Principles of His Philosophy, B. Bonansea's translation of an Italian work by E. Bettoni. The only complete work of Duns Scotus in English translation is his small opus presenting a demonstration of the existence of God: The De Primo Principio of John Duns Scotus, (St. Bonaventure, N. Y.: 1949), translated by Evan Roche, O.F.M. Allan Wolter is presently engaged in producing a new translation with more extensive notes, since the original translation is out of print. A small selection from Scotus' Oxford Commentary is contained in Richard McKeon's Selections from Medieval Philosophers, Vol. II. The reason for the scarcity of translations has been the lack of a definitive edition of BOOK REVIEWS 93 Scotus's works. No one wanted to undertake an extensive translation from insufficiently edited texts, especially when a definitive text was thought to be imminent. A commission was appointed thirty-six years ago to do for John Duns Scotus what had been done so magnificently for his Franciscan predecessor, St. Bonaventure. The first definitive edition of the opera ornnia of a Scholastic in the period of Scholastic revival was published by Franciscan scholars at Quaracchi near Florence: the Opera Ornnia Sancti Bonaventurae (1882-1901) in nine volumes. The same scholars, under the leadership of E. Longpr~, O.F.M., turned their attention to the works of Scotus. The problems facing the commission were admittedly much greater. We can see from the analysis set out here that the two accounts that were the focus of consideration are complementary to one another. It has been my contention that a problem like specifying a concept such as ‘refrain’ is highly complex. One part of it is the problem of determining the relation between the action (or event) and the result. Another part of the problem is that of describing the event itself; what kind of an event is it? These (...) two projects are related and so it is clear that the results must be consistent. However, it is equally clear that the definition which is useful for one project is not the same as that which is helpful for another. The point is that it should not be assumed that an account that initially looks incompatible with one's own must be refuted. It is sometimes better to consider what is needed for a complete account, and whether many different approaches may contribute pieces to the puzzle.We have here one puzzle piece: an analysis of refraining. It should not be assumed that we have thereby completed the puzzle of omission, but omission can be approached the same way; that is, by coordinating parallel projects.Accordingly, the first benefit of the present analysis is that it sets up an approach which is modular in nature. It allows for parallel projects to be pursued separately and coordinated. This kind of approach is sorely needed in this area to counter unproductive dispute.To see how such an approach can be applied to further problems profitably consider the following persistent controversy. Many philosophers are at odds over the importance of the notion of duty, or more informally, reasonable expectation in the understanding of refraining. A number of them (e.g., Hart and Honore, John Casey, and Phillipa Foot) hold that the determining feature for the ascription of responsibility to an agent for not doing something to prevent a harm (say, a death) is the presence of a duty or reasonable expectation that the agent do something about the situation. For example, John Casey holds, “If a man does not do x, we cannot properly say that his not doing x is the cause of some result y, unless in the normal course of events he could have been expected to do x.” Casey, Actions and Consequences (1978).Other philosophers object that a person can cause a result by refraining from (causally) preventing it, and that such an event can be explained without any reference to duty. These two views appear to conflict, but in fact they are both right (but both incomplete). The reason that the above statements are generally thought to constitute a disagreement is that ‘refrain’ is generally taken as the fundamental term of analysis for omissions. Thus, if Casey says, “If a man does not do x...” he is taken to mean “...if a man refrains from doing x...” But he need not mean that. He may mean to say only that the man failed to do x. See my analysis in “Contemplating Failure,” supra note 10. Failing to do something can be, and ordinarily is, thought of as stronger than simple nonaction. But it is much weaker than refraining. For one thing, it has no awareness requirement. Thus, an account like Casey's can explain the ascription of responsibility and the presence of an omission where Green's account (or the account offered here) cannot, and vice versa. Casey's view can explain why we hold (or at least that we hold) responsible the night watchman who forgets to check one of the windows, the bookkeeper who (accidentally) omits an entry in the accounts, or the private duty nurse who fails to prevent a death by falling asleep on the job. No refraining is present in any of these cases. Consequently, any thesis based on refraining alone cannot explain them. But in many cases refraining is precisely what is important, and Green (and others of the same persuasion) are correct to point out that no reference to duty is necessarily required to account for these cases. Analysis based on refraining best explains intentional or conscious omission. Analysis based on duty or reasonable expectation is the only way to explain unconscious omission. More often than not, both elements are present. A complete account of omission needs both. So here again, the better way to view these putatively competing accounts is as parallel projects which work toward a common, but complex end. The approach taken here allows for this kind of much needed coordination. The second benefit of the present analysis is that it clarifies and focuses on the significance of the mental element of refraining. Refraining is conscious omission. Consciousness and omission are its distinguishing features. The effects of seeing the concept this way are pervasive. Here is one example. If I refrain from reporting my full income to the IRS, I have committed fraud, and punitive or even criminal sanctions may be reasonable. If I fail to report my full income through ignorance or mistake (say, I misunderstood the instructions) correcting the error and requiring payment is reasonable, but certainly criminal sanction is not. This oversimplifies the distinction, but it illustrates the focus of my pursuit.With regard to positive actions, law and philosophy have long recognized this important distinction as manifested in the difference between negligence and intentional tort, or manslaughter and murder. Due (I think) to the extraordinary flexibility of language and the weakness and variability of social conventions regarding omissions, this distinction has not been clearly articulated. This article presents a study on the ethical dilemma of whistleblowing in physical therapy, and suggests some lines for further research on this topic as well as ways for integrating it in the physical therapy curriculum. The study examines the self-reported willingness of physical therapy students to report misconduct, whether internally or externally, to protect the patient's interests. Internal disclosure entails reporting the wrongdoing to an authority within the organisation. External disclosure entails reporting the offence to an outside agency, such (...) as the police, professional organisation, or press. The findings indicate that the students view the acts that are detrimental or cause injustice to the patient in a very serious light. In dilemma situations such as these, the students reported a willingness to act. The students also report considerably greater likelihood of whistleblowing internally than externally. The pattern reveals a desire to correct the misconduct coupled with a marked decline in the willingness to blow the whistle as this act moved from the workplace to an external authority. (shrink)

Background and objectives Conscientious refusal of abortion has been discussed widely by medical ethicists but little information on practitioners' opinions exists. The American College of Obstetricians and Gynecologists (ACOG) issued recommendations about conscientious refusal. We used a vignette experiment to examine obstetrician-gynecologists' (OB/GYN) support for the recommendations. Design A national survey of OB/GYN physicians contained a vignette experiment in which an OB/GYN doctor refused a requested elective abortion. The vignette varied two issues recently addressed by the ACOG ethics committee—whether the (...) doctor referred and whether the doctor disclosed their objection to the abortion. Participants and setting 1800 OB/GYN randomly selected physicians were asked to complete a mail survey containing the vignette. The response rate was 66% (n=1154) after excluding 40 ineligible cases. Measurement Physicians indicated their approval for the vignette doctor's decision. Main results Overall, 43% of OB/GYN physicians responded that the conscientious refusal exercised by the vignette physician was appropriate. 70% rated the vignette doctor as acting appropriately when a referral was made. This dropped to 51% when the doctor disclosed objections to the patient, and to 12% when the doctor disclosed objections and refused to make a referral. Consistent with previous research, males were more likely to support disclosure and refusal to refer. Highly religious physicians supported non-referral but not disclosure. Conclusion OB/GYN physicians are less likely to support conscientious refusal of abortion if physicians disclose their objections to patients. This is at odds with ACOG recommendations and with some models of the doctor–patient relationship. (shrink)

The aim of this study is to gain an understanding of why employees misuse information systems resources in the workplace. Rather than consider “intention,” as existing behavioral research commonly does, this study investigates actual behavior and employs IS resource misuse as the dependent variable. Data from a web-based survey are analyzed using the partial least squares approach. In light of the dual-process approach and the theory of planned behavior, the findings suggest that IS resource misuse may be both an intentional (...) type of behavior and an unreasoned action. Perceived behavioral control influences employees’ IS resource misuse actions via their desires or intentions, whereas attitude toward such misuse affects these actions via employees’ desires alone. Subjective norm is found not to affect employees’ IS resource misuse via either desires or intentions. In terms of its theoretical contribution, this study considers unethical behavior in information systems by incorporating a dual-process model and the theory of planned behavior. With regard to its managerial significance, the study’s results will help managers to better understand why employees commit IS resource misuse within organizations. (shrink)

This study investigated the differences between past and future temporal discounting in terms of neural activity in relation to temporal distance. Results show that brain regions are engaged differently in past and future temporal discounting. This is likely because past temporal discounting requires memory reconstruction, whereas future temporal discounting requires the processing of uncertainty about the future. In past temporal discounting, neural activity differed only when preferences were made between rewards received one hour prior and rewards received further in the (...) past. The peak amplitudes of P2 and P3 varied as the temporal distance increased from 2 weeks to 50 years. In future temporal discounting, neural activity differed only when preferences were evaluated between two delayed rewards. The delay conditions and had a significant influence on P2 and N2. Findings indicate the existence of different decision-making systems operating in past and future temporal discounting. (shrink)

Two thought experiments are discussed which suggest, first, a geometric interpretation of the concept of a (say, vector) potential (i.e., as a kinematic quantity associated with a transformation between moving frames of reference suitably related to the problem) and, second, that, in a quantum treatment one should extend the notion of the equivalence principle to include not only the equivalence of inertial forces with suitable “real” forces, but also the equivalence of potentials of such inertial forces and the potentials of (...) suitable real forces. The two types of cancellation are physically independent of each other, because of the Aharonov-Bohm effect. Finally, we show that the latter effect itself can be understood “geometrically” as a kinematic effect arising upon the transformation between the two reference frames. (shrink)

In his 1936 paper,On the Concept of Logical Consequence, Tarski introduced the celebrated definition oflogical consequence: “The sentenceσfollows logicallyfrom the sentences of the class Γ if and only if every model of the class Γ is also a model of the sentenceσ.” [55, p. 417] This definition, Tarski said, is based on two very basic intuitions, “essential for the proper concept of consequence” [55, p. 415] and reflecting common linguistic usage: “Consider any class Γ of sentences and a sentence which (...) follows from the sentences of this class. From an intuitive standpoint it can never happen that both the class Γ consists only of true sentences and the sentenceσis false. Moreover, … we are concerned here with the concept of logical, i.e.,formal, consequence.” [55, p. 414] Tarski believed his definition of logical consequence captured the intuitive notion: “It seems to me that everyone who understands the content of the above definition must admit that it agrees quite well with common usage. … In particular, it can be proved, on the basis of this definition, that every consequence of true sentences must be true.” [55, p. 417] The formality of Tarskian consequences can also be proven. Tarski's definition of logical consequence had a key role in the development of the model-theoretic semantics of modern logic and has stayed at its center ever since. (shrink)
